Terms of Service

These Terms of Service (“Terms”) govern your access to and use of AdsFetch’s websites, applications, and services (collectively, the “Services”).

1. Agreement to Terms

By accessing or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization and “you” refers to that organization.

2. Eligibility

You must be legally able to enter into this agreement and use the Services in compliance with applicable laws.

3. Account Registration and Security

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for activities that occur under your account.
  • You must promptly notify us of any unauthorized access or security incident.

4. Use of the Services

4.1 Permitted use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Services for your internal business purposes.

4.2 Prohibited use

You agree not to:

  • Use the Services to violate any law or infringe the rights of others.
  • Attempt to gain unauthorized access to the Services or related systems.
  • Reverse engineer, decompile, or attempt to extract source code (except where prohibited by law).
  • Interfere with or disrupt the Services, including by transmitting malware or abusive traffic.
  • Resell, rent, or sublicense the Services unless expressly permitted in writing.

5. Integrations and Third-Party Services

The Services may interoperate with third-party services you choose to connect. Your use of third-party services is governed by their terms and policies. You represent that you have the necessary rights and permissions to connect accounts and process data via the Services.

6. Customer Data

“Customer Data” means data you submit to or process through the Services. As between you and AdsFetch, you retain all rights to Customer Data. You grant us the rights necessary to host, process, transmit, and display Customer Data solely to provide and improve the Services and as described in our Privacy Policy.

7. Feedback

If you provide feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free right to use them without restriction or compensation.

8. Fees and Payment (If Applicable)

If you subscribe to a paid plan, you agree to pay applicable fees and taxes. Additional billing terms may apply depending on your plan and payment method.

9. Term and Termination

  • These Terms remain in effect while you use the Services.
  • You may stop using the Services at any time.
  • We may suspend or terminate access if we reasonably believe you violated these Terms or if needed to protect the Services, users, or third parties.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADSFETCH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADSFETCH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADSFETCH’S TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO ADSFETCH FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless AdsFetch from claims, damages, liabilities, and expenses arising from (a) your use of the Services, (b) your Customer Data, or (c) your violation of these Terms or applicable law.

13. Governing Law

These Terms are governed by the laws of the jurisdiction where AdsFetch is established, without regard to conflict-of-law rules. (Replace this section with your preferred governing law/venue.)

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you by posting updated Terms or through the Services. Continued use after the effective date of an update constitutes acceptance.
